Anna is a senior member of the firm’s employment group that defends a “Fortune 500” retailer in employment related matters. She brings over ten years of experience defending national and regional businesses against allegations of unlawful employment practices. Anna’s responsibilities include managing agency and litigated claims from filing to resolution.  Anna regularly appears in state and federal courts throughout Pennsylvania and New Jersey.  She has also appeared before administrative agencies such as the Equal Employment Opportunity Commission, the Pennsylvania Human Relations Commission, and the New Jersey Division on Civil Rights.

Anna’s representation of employers has resulted in significant dispositive rulings at the federal and state level. In federal court, she has obtained dismissals and favorable decisions for employers on Title VII and Americans with Disabilities Act claims. In plaintiff-friendly New Jersey state court, Anna has obtained numerous favorable decisions including summary judgment for a retailer on a public accommodation claim. Anna has also proven to be an effective negotiator, resolving hundreds of cases through the EEOC’s mediation program, and with private mediators, including favorably settling large exposure cases with claimed damages in excess of $2 million before massive litigation costs were incurred.

Anna also utilizes her employment skill set in complex tort cases asserting negligent hiring and matters implicating corporate liability for management or employee-committed torts. Because these cases often emanate from workplace or employment related policies, Anna brings a unique perspective in investigating and evaluating complex tort claims arising from workplace acts or omissions. She has experience handling cases involving violence or fatal assaults from alleged violations of workplace safety or practices.

Anna is an active participant in the National Association of Minority and Women Owned Law Firms and  participates in the Labor and Employment Law practice group.  Anna is also actively involved in the Network of Executive Women and the National Association of Women Lawyers

Successfully defended a national retail pharmacy against a race discrimination claim under the New Jersey Law Against Discrimination. A customer of the retailer argued that he had been unlawfully denied access to services because of his race when an hourly associate referred to him using a racial slur. Management apologized to the customer and the employee was fired following an investigation into the incident. Ms. Darpino obtained a summary judgment in favor of the retailer when she successfully argued that the retailer could not be held liable for the non-management employee’s isolated comment.

Obtained dismissal by way of FRCP 12(b) (6) on behalf of the client in case arising under Title VII and the Americans with Disabilities Act. The plaintiff, a former pharmacist, alleged that his job assignments were made in a discriminatory fashion and that he was terminated in retaliation after he complained. The court dismissed the action, based on the employee’s failure to allege facts sufficient to state plausible claims for relief and procedural defects with plaintiff’s complaint.
