Rebecca Prosper brings significant litigation and trial experience to the firm’s defense team. Rebecca concentrates her legal practice in the areas of premises liability and premises security for one of the nation’s largest retailers. Rebecca manages her own caseload and handles all aspects of her cases including discovery, depositions, motion practice, and arbitrations. Rebecca practices in both state and federal court in Pennsylvania.

Prior to joining McDonnell & Associates, Rebecca served as an Assistant City Solicitor in the Civil Rights Unit for the City of Philadelphia. During her tenure with the City, Rebecca handled hundreds of cases as lead attorney trying twelve (12) cases to verdict in state and federal court. Rebecca also litigated many cases to final disposition before arbitration panels. In addition to appearing before arbitration panels, Rebecca served as an arbitrator adjudicating cases in personal injury, premises liability, and motor vehicle accidents.

Following her position as an Assistant City Solicitor, Rebecca worked as an associate attorney in a mid-sized Mid-Atlantic firm where she specialized in insurance recovery litigation. Rebecca represented policyholders in insurance recovery actions where she prepared pleadings and motions, and handled depositions and discovery.

Rebecca was selected to participate in Drexel University’s Leading for Change Fellowship 2017-2018 in recognition of her leadership ability. The program involved identifying and providing possible solutions to challenges facing the City of Philadelphia. During the yearlong practicum, Rebecca worked cooperatively with other leaders in the Philadelphia City Government to develop strategies to address the challenges identified in a cost and socially conscience manner.

Rebecca graduated from Penn State University where she earned her B.S. in Crime, Law, and Justice with a minor in African and African American Studies. Rebecca received her J.D. from Temple University’s Beasley School of Law where she served as the Treasurer for the Black Law Student’s Association and a teaching assistant for the Integrated Trial Advocacy Program (ITAP). While in law school, Rebecca interned for the Honorable Michael Erdos in the Philadelphia Court of Common Pleas, Criminal Division.

As an Assistant City Solicitor, Rebecca represented hundreds of City employees including police personnel, prison staff, and City Council, and defended them in actions alleging various civil rights violations from over-crowding in prison cells (“triple-celling”) to allegations of assault and battery.

During Rebecca’s private practice experience, she had the opportunity to represent a wide-range of clients including individuals and large corporations, and worked to recover policy limits for covered or disputed losses.

Publications

Rebecca has conducted numerous presentations for the Philadelphia Police Department recruits highlighting various aspects of civil rights litigation. These presentations covered multiple topics including the importance of creating and maintaining proper documentation, providing candid testimony, and proactive steps to minimize potential lawsuits.
